Agricultural Policy & EHS Compliance Architecture

The agricultural supply chain faces intense, overlapping regulatory pressures from every angle—the EPA, OSHA, DOT, and DHS. At Kennedy Law and Policy, we don't just advise on these regulations; we build the enterprise systems that solve them.

Having served as the lead EHS advocate and lobbyist for the agricultural retail sector, we bring a proven track record of uniting trade associations, defeating regulatory overreach, and shaping landmark legislation. Whether navigating post-incident crisis management or lobbying on the Farm Bill, we protect the critical infrastructure that feeds the nation and fuels the energy transition.

Featured Agricultural Advocacy & Industry Solutions

  • Architecting Industry-Wide Compliance ("ResponsibleAg")

    • The Solution: To combat an overwhelming surge in post-incident federal regulations, we conceptualized and spearheaded the creation of ResponsibleAg—the agriculture industry’s flagship EHS and security certification program.

    • The Impact: We translated hundreds of complex EPA, OSHA, DOT, and DHS regulations into a unified, nationwide auditing framework. Today, this system is utilized by over 2,500 facilities to ensure rigorous, proactive federal compliance.

  • Legislative Lobbying: The Farm Bill & Sustainable Fuels

    • The Advocacy: Directly lobbied Congress and federal agencies to shape high-stakes industry legislation that dictates the future of the agricultural economy.

    • The Impact: Managed comprehensive advocacy portfolios covering the Farm Bill, the advancement of sustainable fuels, and the defense of agricultural supply chain resiliency against burdensome federal mandates.

  • Defeating OSHA Regulatory Overreach

    • The Advocacy: When agencies attempt to bypass formal rulemaking, we push back. We successfully defeated a proposed statutory interpretation of an OSHA Process Safety Management (PSM) guidance document.

    • The Impact: This decisive legal advocacy spared the agricultural supply chain from unworkable, multi-million dollar compliance standards while maintaining practical workplace safety protocols.

  • Critical Infrastructure Security (CFATS) & Crisis Management

    • The Advocacy: In the wake of crises like the West Texas chemical explosion (Executive Order 13650), businesses need an advocate who can navigate intense interagency scrutiny. We testified before the EPA, DOT, DHS, and OSHA regarding emergency response challenges.

    • The Impact: Lobbied lawmakers to shape the Chemical Facility Anti-Terrorism Standards (CFATS) and served as the elected Assistant Chair of the Chemical Sector Coordinating Council (CSCC), ensuring federal security mandates remained workable for everyday agricultural operations.
